These Terms of Service ("Terms") govern your use of the websites, training platform and services (the "Services") provided by EZPZ Train, Inc. ("EZPZ Train", "we", "our" or "us"), 12077 N. 81st Street, Scottsdale, AZ 85260. By using the Services, placing an order, or submitting information through our website, you agree to these Terms. If you are using the Services for a company, you confirm you are authorized to accept these Terms for it.
1. The Services
EZPZ Train provides mobile microlearning: short training videos and knowledge checks delivered to employees' phones by text message or email link, with completion tracking, certificates and reports. Course content, features and the course library may change over time.
2. Orders, invoices and payment
Orders are placed through our website checkout or by invoice. Prices are shown at checkout or on your invoice. Payment is due as stated on the invoice. Training seats and platform access run for the term stated in your order (for the Anti-Harassment Compliance Course, 12 months from purchase). Unless the law requires otherwise, fees are non-refundable once training has been deployed to your employees.
3. Your responsibilities
You are responsible for the accuracy of the information you give us, including employee rosters, and for having the right to provide your employees' names, email addresses and mobile numbers to us so we can deliver training on your behalf. You agree not to misuse the Services, interfere with their operation, or copy, resell or redistribute our content.
4. Training is not legal advice
Our courses provide general training and information. They are not legal advice, and completing a course does not by itself guarantee compliance with any law. Requirements differ by state and city and change over time; consult your own counsel about your obligations.
5. Intellectual property
All course content, videos, software, trademarks and materials in the Services belong to EZPZ Train or its licensors. We grant you a limited, non-transferable right to use them for your internal training during your term.
6. Disclaimers and limitation of liability
The Services are provided "as is" and "as available". To the fullest extent permitted by law, EZPZ Train disclaims all implied warranties, and our total liability for any claim related to the Services is limited to the amount you paid us for the Services in the 12 months before the claim. We are not liable for indirect, incidental, special or consequential damages.
7. Termination
We may suspend or end access to the Services if these Terms are violated. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.
8. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules.
9. SMS / text message terms
Program. EZPZ Train sends text messages to people who opt in, for example through the consent checkbox in our website chat widget. Messages may include replies to your questions, appointment reminders, account and order updates, training notifications, and occasional information about our products and offers.
Consent. Consent to receive text messages is optional and is not a condition of any purchase. Opt-in is collected through an unchecked checkbox.
Frequency. Message frequency varies.
Costs. Message and data rates may apply.
Opt out. Reply STOP to any message to stop receiving texts. You will receive one confirmation message and no further messages unless you opt in again.
Help. Reply HELP for help, or contact us at info@ezpztrain.com or 833-577-EZPZ (3979).
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Privacy. We do not share mobile numbers or text message opt-in data and consent with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows when they last changed. Continued use of the Services after a change means you accept the updated Terms.
